Overview
Are you a director or senior manager responsible for H&S within your business? Did you know you could be personally prosecuted for a H&S offence?
People often consider prosecution for H&S failings to be a corporate risk alone, but that’s not the case. Directors and Senior Managers can be prosecuted too, with unlimited fines and prison sentences being imposed if convicted.
Come along to this webinar to find out:
Amy Anderson, Senior Associate, Brodies LLP
Amy represents both corporate and individual clients facing investigation and/or prosecution for health and safety offences and other regulatory matters. She also represents clients at Fatal Accident Inquiries.
Amy advises clients who are subject to investigation by the HSE, local authorities including Environmental Health and Trading Standards, Scottish Environment Protection Agency, Care Inspectorate, Scottish Legal Complaints Commission and the Law Society of Scotland, among others. She advises clients on all aspects of regulatory investigations, including enforcement action.
Her clients span a variety of sectors including construction, manufacturing, agriculture, social housing, energy, accommodation and hospitality, healthcare and social care.
She regularly attends client premises in the immediate aftermath of a serious incident, providing incident management advice and guiding clients through the early stages of a regulator's investigation to ensure their position is protected as far as possible.
Amy also provides compliance advice to clients helping them to comply with often onerous regulatory regimes.
